A man who was recently indicted for the death of a Denison teacher has been jailed on a charge of manslaughter. He is being held on a $1,000,000 bond.
Foster was indicted on Oct. 8 for manslaughter in relation to the 2020 death of Katie Palmer, 38. Foster is accused of striking Palmer with his truck as she and her husband John Palmer were walking east on Glenwood Drive at around 7:45 a.m. April 22.
John Palmer was also struck by the F250 that Foster was driving but survived the collision with injuries.
Court records show John Hunter Smith is representing Foster in the criminal case that is being prosecuted by a district attorney from Kaufman County, Marc Moffitt.
Grayson County District Attorney John Kermit Hill told a local news outlet that he recused himself from the case due to his relationship with the Palmer family and to avoid the appearance of bias in the case. He said the Kaufman County district attorney presented the Foster case to the grand jury.
Former Grayson County District Attorney Brett Smith said in answers to questions during the last election cycle that he taken the Foster case to two different grand juries on three different tries and got a refusal to indict each time.
The case took on a life of its own during the most recent race for the Republican Primary for the Grayson County District Attorney’s Office. Hill ended up beating incumbent Smith in that election and then won the November election as well.
