Grayson County District Attorney John Kermitt Hill recently released a list of individuals who have been indicted recently by Grayson County grand jurors.
Grand jurors look at the case presented by the district attorney’s office to see if there is enough probable cause to bring a case to trial. If they decide there is a sufficient amount of evidence to move the case forward to court, the person is indicted. If jurors decide there is not enough evidence to move forward, the person is no billed or not indicted. In Grayson County, a list of people indicted by each grand jury is posted on the county’s website and released to the media. The names of people who are no billed are not generally released to the public.
Grand juries are made up of 12 people just like most petit or trial juries and two alternates.
Once the grand jury is impaneled, they pick a foreperson just like a trial jury. Juror selection, however, is not done in open court the way it is in a trial. They are picked at random from a list of eligible people in the county.
Grand juries meet in secrecy to protect the accused, the witnesses and the grand jurors. District attorneys present evidence to grand jurors and witnesses can give testimony. Like trial juries, grand jurors can only discuss the cases before them with each other and the judge presiding over the case. Grand jurors are not allowed to discuss the cases presented to them with their family or friends or general public.
Unlike trial juries, not all 12 grand jurors are required to bring an indictment. If nine or more of the 12 vote to true bill a case, then the case is indicted. If, however, eight or less vote to no bill, then the case is not indicted.
Indictments are formal charges and are not an indication of guilt.
