Sherman attorney Lester Vance was indicted Wednesday on charges of assault on a security officer, assault of an emergency personnel, injury to a child/elderly/ disabled person with bodily injury and obstruction or retaliation.
The indictments are formal charges and are not an indication of guilt.
The charges of assault on a security officer and emergency personnel stem from an incident at Wilson N. Jones Regional Medical Center back in February. In a statement to the Herald Democrat at the time of that incident, Sherman Police Sgt. D. M. Hampton said police were called to the WNJ. Once there, Hampton said, they found that Vance was involved in a disturbance inside the ER where he had allegedly slapped a nurse on the arm. Hampton said a security guard intervened and Vance started kicking the guard.
When reached for a comment Wednesday about the indictments, Vance said he was unaware that the cases were being presented to the grand jury. He said he was under the impression that the cases were being transferred to the McKinney District Attorney’s Office because Grayson County District Attorney Joe Brown felt the case presented a conflict of interest for his office.
Grayson County District Attorney Joe Brown confirmed that the Collin County District Attorney’s Office has been appointed as special prosecutor in the case.
Vance said he doesn’t really remember what happened at the ER. He said he had taken some blood pressure medication and was in his office watching the news and drinking some wine when he ‘fell out.” He said he hit his head and got up and then fell again. He woke up in the hospital, he said, and the nurse was telling someone why she needed him arrested.
“If I hit somebody, I am sorry. I didn’t mean to,” Vance said Wednesday.
As for the charges of injury to an elderly person, Vance said he has been taking care of his mother for years and she is suffering from dementia. He said she sometimes gets confused and thinks he is his father.
