A Van Alstyne man is back in trouble with the law this week after being indicted on three counts of aggravated assault with a deadly weapon with serious bodily injury and one count of unlawful possession of a weapon by a felon. The indictments are formal charges and are not an indication of guilt.


Rory Hogenson, 55, was previously convicted in April 2014 of obstruction or retaliation for dumping nails behind Texas Department of Public Safety Trooper Michael Landero’s squad car in his driveway for a year. Landero had pulled Hogenson over for DWI on U.S. Highway 75 in 2012. Grayson County court records show Hogenson pleaded guilty to the driving while intoxicated charge on Aug. 3, 2012 in Grayson County Court-at-law 2. He was sentenced to five years in prison on that charge.


An affidavit used to secure the most recent indictment states that at around midnight on May 15, deputies spoke with Edward Hogenson, the son of Rory Hogenson, about an incident that had occurred in the 900 block of Edwards Road. Edward Hogenson told deputies that Rory Hogenson had made threats against Edward Hogenson’s wife and his two-year-old daughter. Edward Hogenson showed deputies a text that he said was from his father, that said, “Every Dies,” which Edward Hogenson took to mean everyone dies. Edward Hogenson told deputies he had just talked to his father before meeting with them and Rory Hogenson had said if anyone came down the driveway he would put a bullet in their head. Edward Hogenson said he thinks his father wanted to die from suicide by cop, the affidavit said.


Edward Hogenson told deputies that during an argument at their home, he, his wife and daughter attempted to leave the residence and Rory Hogenson pointed a 30/30 rifle at them. While deputies were talking to Edward Hogenson, he took a phone call from his father. With the call on speaker phone, deputies could hear as Rory Hogenson said he was going to be 100 percent on point. Edward Hogenson’s wife told investigators that Rory Hogenson was upset that her brother was at the home. The wife was trying to put her daughter in the vehicle, she told police, when Rory Hogenson put his rifle up to his shoulder as if he were hunting something and said, “your whole family is dead.” The wife said the rifle was pointing at the car that she, her husband and daughter were all in at the time.


A search of Rory Hogenson’s Grayson County court records did not indicate he had an attorney to represent him on the aggravated assault and unlawful possession of a firearm charges.
