(Editor's note: This article has been updated with the identity of the man who was shot.)

A 25-year-old man was transported to the hospital for a gunshot wound to the head in what Denison Police said was an accidental shooting early Friday morning.

At about 12:08 a.m., police responded to the parking lot of Tupelo Honey Bar and Grill at 130 E. Woodard St. Denison Police Lt. Mike Eppler said a wounded man inside a vehicle was transported by helicopter to a Plano hospital. Police identified the victim as Devin Wayne Owens of Denison. Eppler said Friday afternoon Owens was listed in critical condition and noted the head injury was potentially life-threatening.

A group of people were inside a vehicle, and they had previously visited a Sherman establishment before going to Denison, Eppler said. While they were in the parking lot, a passenger in the back seat was in possession of a firearm, which Eppler noted was reported stolen several months ago to Sherman Police. Eppler said he did not know how many people were in the vehicle.

“The alleged shooter in the backseat pointed the gun at the victim and pulled the trigger thinking the gun was not loaded, and it was,” Eppler said.

The victim was in the driver’s seat when the shooting occurred. The alleged shooter then got out of the vehicle and fled on foot. Eppler said officers knew the identity of the 26-year-old man, and police went to his residence.

“Officers contacted him, and he wasn’t arrested,” Eppler said. “He was taken down to the station and questioned and then released.”

No charges have been filed against the shooter as of Friday morning. Eppler said the condition of the victim and what police find in the investigation will determine whether or not charges will be brought against the man. Police will not release the identity of the alleged shooter until and if charges are filed.

“What it looks like right now — at least at this point — it was an accidental shooting,” Eppler said.
