Hussey sentenced for shooting at DPS officer

BY JERRIE WHITELEY

HERALD DEMOCRAT

SHERMAN -- A decision handed down Thursday by state District Judge Rayburn Nall means Christopher Hussey, a Plano man convicted earlier this month on aggravated assault of public servant, will be eligible for parole in 10 years.

A Grayson County jury convicted Hussey of the assault charge in September and decided his punishment should be 30 years in prion. Nall set the matter for a sentencing hearing.

The state wanted the sentence Hussey received in Grayson County to be stacked on top of a 20-year sentence he received from a Collin County jury for armed robbery in Plano. Hussey had been sentenced by a jury to 20 years in 2004 in Collin County for an aggravated robbery when he stole prescription medication from an Eckerd's drug store in Plano. The Grayson County charge arose later that same day when Hussey fired a shotgun from a moving vehicle at a Texas Department of Public Safety patrol officer in Pottsboro during a high speed chase.

On Thursday, Nall allowed Hussey to serve the two sentences at the same time which Grayson County District Attorney Joe Brown said means Hussey could be eligible for parole in about 10 years.

"We were disappointed," said Brown. "In light of the fact that an officer was shot at, a lot of people were endangered, and that Hussey had never taken responsibility and forced two counties to put him to trial, I thought the judge might stack the sentences."

Hussey will be given credit for the years he has already been in prison. Hussey's attorney, Keith Brown, could not be reached for comment Thursday.

DPS Officer - shot at : 11/3/2009
I do believe Rim Nall will feel some people holding on to their votes come that time of year again (I know I will be). The criminal shouldn't be given credit for anything other than being a criminal. Let him put that on his resume.

JUSTICE FOR WHO???? : 11/1/2009
DOES THIS JUDGE NEED TO GO BACK TO COLLEGE FOR A REFRESHER COARSE? DID HE STOP TO THINK IT COULD HAVE BEEN HIM &/OR SOME OF HIS FAMILY THAT COULD HAVE BEEN SHOT AT? WHAT IS HE THINKING?? WHERE IS THE JUSTICE SYSTEM, THESE DAYS? I HAVE 2 SMALL GRANDCHILDREN & IT REALLY BOTHERS ME TO THINK WHAT OUR LAWS WILL BE LIKE WHEN THEY ARE TEEN-AGERS? WE READ EVERYDAY IN THE PAPERS, SEE IN THE NEWS, WHERE SOMEONE HAS BEEN KILLED;, OR A CHILD IS MISSING. WHAT IS IT GOING TO TAKE FOR US AS PARENTS; & GRANDPARENTS, TO WAKE UP & SAY WE NEED TO PUT PEOPLE INTO OFFICE THAT AREN'T AFFRAID TO INFORCE STRICT LAWS TO CRIMINALS. WE ALSO NEED TO PUT PRAY BACK INTO SCHOOLS, & INTO AMERICA. GOD IS STILL WATCHING OVER US, LET'S STOP TURNING OUR BACKS ON HIM.

What criminal justice : 10/30/2009
This just proves the criminal justice system is broken. The bad guys get away with anything they want while the innocent folks are punished. It is time for a nation-wide change in the way we do things. Our Constitution was designed to protect the innocent, not the guilty.

Too Bad : 10/30/2009
It's too bad that Nall saw fit to let this "potential cop killer" runsentences concurrently. Bad decision Mr. Nall! I know people who have done 10 years or so for drug-related charges and theft (which I think they should have). It's a shame that someone can commit armed robbery, fire a gun at a law officer, endanger many lives, and get out scott free in 10 years!

well @ last he in prion now : 10/29/2009
punishment should be 30 years in prion. Nall set the matter for a sentencing hearing.
