Grayson County jail bond election canceled; entire process could begin anew

SHERMAN -- There will be no Grayson County Jail bond election Nov. 3. County Judge Drue Bynum said Thursday he also holds little hope of getting a privately built and operated jail approved. So Grayson County will begin anew the process of deciding what to do with an aging jail and future inmate populations.

"Grayson County will have a lot of soul searching to do," Bynum said.

On Wednesday, Combined Law Enforcement Associations of Texas announced they would file a lawsuit challenging the legality of the Aug. 31 Grayson County Commissionrs Court meeting. The challenge, if successful, would void every action of that meeting. CLEAT's announcement said that notice of the meeting gave the public less than the 72 hours required by at least a minute, likely more.

Bynum said Thursday that documentation did not exist to prove CLEAT wrong. He said he believed the meeting was actually posted on the Internet four to seven minutes before the deadline of 10 a.m. Aug. 28, however a later revision in the order of business changed the time stamp. That erased any evidence.

Grayson County Commissioners Court faced a Sept. 3 deadline to call the bond election to pay for a new or remodeled and expanded jail. That deadline has passed, so the next opportunity to have an election would be May 8, 2010. Bynum said all the other items on that agenda would be posted again for Monday's meeting.

"As much as I hate to acknowledge it, we were late and we didn't meet the letter of the law. I think we certainly met the spirit," Bynum said in a telephone interview. "I am willing to void the entire 31 Aug. agenda. ... Obviously we won't need to ratify the entire bond election, because it's too late for that."

Bynum said the Court will have to discuss Monday where to go from here on the jail issue.

To Gunter Glen: Don't just give credit to well known Democrats. Republicans also stepped up to the plate. In fact this has been a unifying cause for both Demos and Repubs. Spread the credit around while we stay on guard.

Here is a novel idea. Since the County Judge is so intent on privatizing Government functions to his "secret" friends; why not privatize the County Judge's position first, and then some of the blind followers in the Commissioners Court(3). Let's then see how well privatization works! (Watch the "profits" flow out of Grayson County).

I agree with the writer who usually doesn't like unions. But in this case you have to admire the tenacity of CLEAT who have acted as watchdogs for the employees of the jail and citizens at large. I was present when CLEAT made it clear they would volunteer to represent Sheriff Gary if he needed their help with negotiations with the Commissioners. Thank you caring CLEAT.

Scary when the faith of citizens is with crooks like Majors and Smith. They aren't even decent and they are deciding (stupidly) issues that affect all the citizens of Grayson County. Knowing these men, I say the citizens lose. Bynum is a better man. You've been fooled.

The people wanting a county run jail need to know that whatever the tax increase to build it, it will take another tax increase of almost the same size to run it after it is build. Beaverson is not against the jail being private he is looking for political gain. The Sheriff is the one who asked for a private run jail to start with. Don't fall for the hipe, we can't afford a tax hike locally, Washington is going to raise your cost to live. The mayor says 500 beds will last 10 years, the bond won't be paid off by then.

I'm glad that CLEAT and Sheriff Gary stopped this fiasco from taking place. We need more good people like Sheriff Gary in county politics and not crooks and theives like Bynum and Waldrip. Way to go Sheriff! Now lets build this jail the right way and let Sheriff Gary and his staff run it. Our families will all be much safer this way.

Don't misunderstand the thank you. It's not for the County Judge or the Commissioners Court. This thank you goes to all those upstanding citizen who have tirelessly worked for the rights of the people of Grayson county to decide this issue. Folks like Tony Beaverson, Cynthia Manley & others. The Herald Democrat coverage of the issue was superb due to the efforts of Don Eldredge & Kathy Williams.

Bynum Still Wrong : 9/11/2009
I called the Secretary of State’s office and the Texas Attorney General's Open Government section. I ran all of this by them and this is a summary of what I learned: The County Judge still misses a few points: 1. The posting on the internet does not negate the requirement of the physical posting in advance of 72 hours; and 2. The Commissioners Court cannot meet and simply say that they vote to "ratify" their actions taken in the meeting of August 31, 2009. The Texas courts have already stated that merely ratifying will not meet the requirements of the law. They have to "redo" it as though their discussions and votes on August 31st had never happened, i.e. there is nothing in the eyes of the law to "ratify". Ratification can work with non-governmental organizations, but not with governmental bodies under the Texas Open Meetings Act. Bynum should acknowledge the internet posting regardless of what time they go it up would not override the required posting of the agenda in paper form. Also it looks like it was more than a minute as that was the time it was stamped in the County Clerk’s office, who knows how long it took for someone to post the August 31 agenda. Grayson County would have lost this legal battle. Thank you CLEAT, but keep monitoring what is happening on this issue as many of us will not let our guard down. When a dollar can be made for private companies from the incarceration of people it can be nothing but a slimy way to make money therefore the possibility of this raising its ugly head again is very probable.

They "believed the meeting was actually posted on the Internet four to seven minutes before the deadline"??? Hey, here's an idea, DON'T WAIT UNTIL THE LAST MINUTE TO DO SOMETHING THIS IMPORTANT! It appears our local government is as inefficient as our national government and continue to break their own rules and laws until (as in this case) they are called out on it. Good job CLEAT!!
