SHERMAN -- A decision handed down Thursday by state District Judge Rayburn Nall means Christopher Hussey, a Plano man convicted earlier this month on aggravated assault of public servant, will be eligible for parole in 10 years.
A Grayson County jury convicted Hussey of the assault charge in September and decided his punishment should be 30 years in prion. Nall set the matter for a sentencing hearing.
The state wanted the sentence Hussey received in Grayson County to be stacked on top of a 20-year sentence he received from a Collin County jury for armed robbery in Plano. Hussey had been sentenced by a jury to 20 years in 2004 in Collin County for an aggravated robbery when he stole prescription medication from an Eckerd's drug store in Plano. The Grayson County charge arose later that same day when Hussey fired a shotgun from a moving vehicle at a Texas Department of Public Safety patrol officer in Pottsboro during a high speed chase.
On Thursday, Nall allowed Hussey to serve the two sentences at the same time which Grayson County District Attorney Joe Brown said means Hussey could be eligible for parole in about 10 years.
"We were disappointed," said Brown. "In light of the fact that an officer was shot at, a lot of people were endangered, and that Hussey had never taken responsibility and forced two counties to put him to trial, I thought the judge might stack the sentences."
Hussey will be given credit for the years he has already been in prison. Hussey's attorney, Keith Brown, could not be reached for comment Thursday.
